These Terms of Use (the "Terms") govern your use of and access to www.tournahunapavalley.com and its sub-domains and affiliated sites, as well as J Tournahu Vineyard LLC's ("Tournahu Vineyards" "our", "us" or "we") pages and accounts on Facebook®, LinkedIn®, Instagram®, and YouTube® (the "Sites). Please read these Terms, our Privacy Policy, and our Terms of Sale carefully, all of which are incorporated into these Terms by reference. These Terms specifically govern your use of and access to our Sites, while our Terms of Sale govern any purchases of wine or related products. By using any or all of the Sites, you accept and agree to be bound by these Terms. If you do not want to agree to be bound by these Terms, do not use the Sites. We may modify these Terms from time to time, and any modifications will be effective immediately when we post them. All changes we make will be reflected in the date at the top of the document. You are responsible for reviewing any modified terms. Your continued use of a Site following any changes means you accept and agree to any changes. For your convenience and future reference, the date of the most recent revision of these Terms is listed above so that you may compare different versions to determine what, if any, changes have been made.
SITE CONTENT.
J Tournahu Vineyard LLC exclusively owns and controls the Sites, which provides information about our wines and related products and may, from time to time, provide access to educational materials pertaining to a variety of topics in viniculture. The Sites allow for the online purchase of wine products, which is governed by our separate Terms of Sale. You agree that use or access to any or all of the Sites does not, standing alone, create any sort of representation, warranty, or future promise regarding our products. The unauthorized reproduction, use of, or theft of any content, written, photographic, or otherwise, is expressly prohibited. By using the Sites, you expressly agree to pay a fine of $50 per incident for any unauthorized use of our content, at the sole discretion of J Tournahu Vineyard LLC.
ARTIFICIAL INTELLIGENCE ("AI") DISCLAIMER
We may use AI technology to supplement or enhance content throughout the Sites and related materials. This may include, but is not limited to, AI-generated images, audio, or text ("AI-Generated Content"). However, while these tools may be used to suggest or enhance Site Content, all published content on the Sites or correspondence is wholly human, including but not limited to all opinions, thoughts, and ideas. As such, we expressly retain all copyright ownership to the Site Content. By visiting the Sites, you agree and acknowledge that we are not required to notify you when or how AI technologies are used.
While we have made reasonable efforts to ensure the accuracy and completeness of AI-Generated Content, you agree and understand that we expressly disclaim the accuracy of AI-Generated Content, including any and all liability for any errors or omissions in the Content produced by AI technology, and expressly advise that you exercise caution when relying on such content. As with all Site Content, you agree that use or access to any of the information provided on or knowledge gleaned from the Sites, including AI-Generated Content, does not create any sort of representation or future promise, and that use of any AI-Generated Content on the Sites is at your own risk.

INTELLECTUAL PROPERTY.
Unless explicitly stated otherwise, as between you and J Tournahu Vineyard LLC, J Tournahu Vineyard LLC owns all right, title, and interest in and to the Sites, including, without limitation, graphics, site content, design, organization, compilation and other matters related to or included on the Sites. Our name, J Tournahu Vineyard LLC, Tournahu Vineyards, and all related names, product and service names, logos, slogans, and designs are our trademarks and you may not use these marks without our prior written permission. All other names, logos, product and service names, designs and slogans on the Sites are the trademarks of their respective owners and should not be used without those respective owners' permission. You are granted a non-exclusive, non-transferable, revocable license to access and use the Sites and the resources available for download from the Website strictly in accordance with these Terms.
THIRD PARTY RIGHTS.
Content and materials posted to the Site may be the copyrighted content of others ("Third Party Content") that is used by J Tournahu Vineyard LLC either by permission or under Section 107 of the Copyright Act as "fair use" for purposes such as education and research. We respect the intellectual property of others and ask that you do the same. Users must obtain permission from the owners of any Third-Party Content before copying, distributing or otherwise using those materials. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material will be permitted without the express permission of the copyright owner.

These Terms are governed by the laws of the State of California without regard to any conflict of laws. For any dispute regarding these Terms or the Sites, you agree to submit to the personal and exclusive jurisdiction and venue of the federal and state courts located in Marin County, California.

ALCOHOL SALES AND AGE VERIFICATION.
Our Sites offer wine products for sale to consumers of legal drinking age. By using our Sites, you represent and warrant that you are at least 21 years of age. We reserve the right to refuse any order if we believe the purchaser is under the legal drinking age or if we are unable to verify the purchaser's age. All wine sales and shipments are subject to applicable state and federal laws governing the sale and shipment of alcohol. We ship wine only to states where direct-to-consumer shipments are permitted by law, and we are unable to ship to certain states due to regulatory restrictions. Additional shipping restrictions and fees may apply.

TOURNAHU VINEYARDS
These Terms of Sale ("Terms") govern your purchase of wine and other products through the website www.tournahunapavalley.com (the "Website") operated by J TOURNAHU VINEYARD LLC, doing business as Tournahu Vineyards ("Tournahu Vineyards," "we," "us," or "our"). By placing an order through our Website, you acknowledge that you have read, understood, and agree to be bound by these Terms.
AGE REQUIREMENTS
• The purchase and consumption of alcoholic beverages, including wine, is strictly limited to individuals who are at least 21 years of age. By placing an order through our Website, you represent and warrant that you are at least 21 years of age.
• All wine deliveries require an adult signature (21 years or older) upon delivery. The recipient must present valid government-issued photo identification proving they are of legal drinking age. If a valid ID cannot be presented, or if the recipient is under 21 years of age, the delivery will be rejected, and no refund will be issued.
• Tournahu Vineyards reserves the right to cancel any order if we have reason to believe that the purchaser is under 21 years of age or is purchasing wine for someone under 21 years of age.
ORDERING AND ACCEPTANCE
• All orders placed through our Website are subject to acceptance by Tournahu Vineyards. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or identification of fraud or suspicious activity.
• After placing an order, you will receive an order confirmation email. This email confirms that we have received your order but does not constitute acceptance of your order. An order is not accepted until the products are shipped and you receive a shipping confirmation email.
• In the event that we are unable to fulfill your order, we will notify you by email and provide a full refund for any amounts already charged.
PRICING AND PAYMENT
• All prices listed on our Website are in U.S. Dollars and are exclusive of applicable sales taxes and shipping fees unless otherwise specified.
• Sales tax will be calculated based on the shipping address and the applicable tax rate in the destination state. The exact amount of sales tax will be calculated during checkout and added to your total order.
• We reserve the right to add $0.10 CA CRV per bottle at checkout.
• Tournahu Vineyards accepts major credit cards, including Visa, MasterCard, American Express, and Discover. By providing credit card information, you represent and warrant that you are authorized to use the designated card and authorize us to charge your card for the total amount of your order, including products, shipping, handling, and applicable taxes.
• Payment processing services are provided by third-party payment processors. Tournahu Vineyards does not store your complete credit card information on its servers.
SHIPPING POLICY
• Tournahu Vineyards currently ships wine to the following states: Alaska (air only), Arizona, California, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii (air only), Idaho, Iowa, Maine, Massachusetts, Minnesota, Missouri, Montana, Nebraska, Nevada, New Jersey, New York, Oregon, Pennsylvania, Tennessee, Texas, Vermont, Washington, West Virginia, and Wyoming.
• Tournahu Vineyards does NOT ship to: Arkansas, Delaware, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maryland, Michigan, Mississippi, New Hampshire, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Rhode Island, South Carolina, South Dakota, Utah, Virginia, and Wisconsin.
• Shipping and handling fees will be calculated during checkout based on the destination, weight, and quantity of items in your order.
• Tournahu Vineyards utilizes third-party fulfillment and shipping services for all orders. Standard ground shipping typically takes 5-10 business days from the date of shipment. Expedited shipping options may be available at an additional cost.
• Shipping delays may occur due to weather conditions, carrier delays, or other circumstances beyond our control. Tournahu Vineyards is not responsible for delays once the package has been transferred to the shipping carrier.
• To protect the quality of our wines, we may temporarily hold shipments during periods of extreme heat or cold. In such cases, we will notify you by email.
• It is the responsibility of the customer to ensure that someone 21 years of age or older is available to sign for the delivery. After three failed delivery attempts, the package may be returned to Tournahu Vineyards, and additional shipping charges may apply for reshipment.
TITLE AND RISK OF LOSS
• Title to products and risk of loss passes to the customer upon delivery of the products to the carrier. It is the customer's responsibility to file any claims with carriers for damaged and/or lost shipments.
RETURNS AND REFUNDS
• Due to the nature of wine products and legal restrictions on the return shipment of alcohol, Tournahu Vineyards cannot accept returns of alcoholic beverages unless the product is corked, or flawed.
• If you receive a damaged or defective product, please contact Tournahu Vineyards at info@tournahunapavalley.com within 14 days of delivery. Please include photos of the damaged products and packaging.
• For damaged or defective products, Tournahu Vineyards may, at its discretion:
o Replace the product with an identical product;
o Substitute the product with a similar product of equal value if the original is unavailable; or
o Issue a refund for the purchase price of the product.
• Tournahu Vineyards does not accept returns of undamaged products or products that have been opened.
• Refunds will be issued to the original form of payment and may take 7-10 business days to process.
PRODUCT AVAILABILITY AND DESCRIPTIONS
• All products offered on our Website are subject to availability. We reserve the right to discontinue any product at any time.
• Tournahu Vineyards attempts to be as accurate as possible in describing our products. However, we do not warrant that product descriptions or other content on the Website are accurate, complete, reliable, current, or error-free.
• The vintage, label, and packaging of wine products may vary from the images displayed on the Website.
LIMITATION OF LIABILITY
• TOURNAHU VINEYARDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE WEBSITE OR SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE WEBSITE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
• TOURNAHU VINEYARDS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO TOURNAHU VINEYARDS DURING THE TWELVE (12) MONTH PERIOD PRIOR TO SUCH CLAIM.
COMPLIANCE WITH LAWS
• You agree to comply with all applicable laws and regulations of the federal government, state, and local governments.
• You understand that it is illegal to use a false name or address or to use someone else's name or address to ship or receive wine products.
• Some states have laws that restrict or prohibit the direct shipment of wine to consumers. You are responsible for being aware of the laws in your state regarding the receipt of wine shipments.
INDEMNIFICATION
• You agree to indemnify, defend, and hold harmless Tournahu Vineyards, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms by you.
SEVERABILITY
• If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
GOVERNING LAW
• These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
• Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
CHANGES TO TERMS
• Tournahu Vineyards reserves the right to revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them.
• Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes.
